RBI Cracks Down on HSBC Over Compliance Failures

Lapses in Unclaimed Deposits Raise Customer Concerns

India’s banking watchdog has once again exposed cracks in regulatory compliance. The Reserve Bank of India (RBI) has imposed a monetary penalty of ₹3.18 million on HSBC, highlighting serious lapses in adhering to key banking norms.

The penalty stems from non-compliance with RBI’s directions on inoperative accounts and unclaimed deposits—an area directly linked to customer trust and financial transparency. According to the findings, the bank failed to maintain a searchable database of unclaimed deposits on its website, making it difficult for customers to track potentially forgotten funds.

Even more concerning was the bank’s failure to assign Unclaimed Deposits Reference Numbers (UDRN) to certain deposits transferred to the Depositor Education and Awareness Fund. This lapse raises questions about traceability and accountability in handling customer money.

The violations came to light during RBI’s supervisory inspection based on the bank’s financial position as of March 31, 2025. Despite being given an opportunity to respond and present its case, the charges were upheld, leading to the penalty.

While RBI clarified that the action is limited to regulatory deficiencies and does not question the validity of customer transactions, the incident has sparked concerns about governance standards within major global banks operating in India.

Experts argue that such lapses, especially by a reputed international institution, can erode customer confidence and highlight systemic weaknesses. If compliance gaps exist at this level, the broader banking ecosystem may require closer scrutiny.

The move serves as a stern warning: regulatory oversight is tightening, and even established players are not immune to action. However, it also underscores the urgent need for stronger transparency mechanisms to safeguard customer interests.
