Strict Warning to Employers: Denying Voting Leave May Invite Penalties

The Election Commission of India has issued firm directives ensuring that all eligible voters employed in any organization are granted paid leave on polling days during the 2026 Assembly elections and by-elections. The move aims to boost voter participation and protect democratic rights.
As per the schedule announced on March 15, polling will be held on April 9 in Assam, Kerala, Puducherry, Goa, Karnataka, Nagaland, and Tripura. Tamil Nadu, Gujarat, and Maharashtra will vote on April 23, while West Bengal will conduct polling in two phases on April 23 and April 29.
Under Section 135B of the Representation of the People Act, 1951, every employee—whether in public or private sectors—is entitled to a paid holiday on polling day. Importantly, employers are prohibited from deducting wages for this leave.
The Commission has issued a strict warning that any violation of these provisions will attract penalties. The rule equally applies to daily wage workers and casual laborers, ensuring inclusive electoral participation.
Additionally, employees working outside their registered constituencies will also be entitled to paid leave, enabling them to travel and cast their vote.
The ECI has instructed all state and union territory governments to enforce these provisions rigorously, ensuring that every eligible voter can exercise their franchise freely and conveniently.
